JUSTICE SANJAY PRIYA ORAL ORDER 27-03-2017 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in Barauni (Garhara) P.S. Case No. 437 of 2016 instituted for the offence under Sections 413, 414/34 of the Indian Penal Code and Section 27 of the Arms Act.

There is allegation in the written report that the informant who is the Police Officer got information regarding extraction of the petroleum products from the goods carrier Tankers and he reached near the house of Dablu Singh. The persons assembled there started running away but two of them were apprehended by the police who disclosed their names as Ram Rai and Rajnish Kumar (petitioner). The diesel loaded in a pickup van was found as mentioned in the written report. Two

Patna High Court Cr.Misc. No.6844 of 2017 (3) dt.27-03-2017 2/2 seizure lists have been prepared. From one, recovery is shown from Garhara Railway Yard whereas another recovery is shown from in front of house of Sukesh Singh @ Dablu Singh @ Vidha Singh.

It has been submitted on behalf of the petitioner that nothing has been recovered from conscious possession of the petitioner. The petitioner has no criminal antecedent which is evident from paragraph-3 of the bail petition. Considering the aforesaid facts and circumstances of the case, prayer for bail of the petitioner is allowed. Let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Sub Divisional Judicial Magistrate, Begusarai, in connection with Barauni (Garhara) P.S. Case No. 437 of 2016, subject to the condition that both the bailors will be the close relatives of the petitioner. (Sanjay Priya, J) S.Ali/- U T
