The petitioner apprehends his arrest in Forest Case No. 24 of 2013 registered for the offences punishable under Section 2(15), 27, 29, 26(g) of Wild Life protection Act and 41, 42 and 43 of the Forest Act. The Forest Officer intercepted a Tractor bearing Registration No. BR 24A/7001, which was found that 100 CFT chips were loaded on the trailer of the Tractor.

Learned counsel for the petitioner submits that petitioner is neither driver nor owner of the Tractor. The correct Registration No. of the Tractor is BR 24A/7801. Owner book of the tractor stands in the name of Jaggu Yadav, father of the petitioner. The

Patna High Court Cr.Misc. No.8159 of 2015 (2) dt.02-03-2015 driver fled away. There is no allegation against the petitioner.

Considering the facts that petitioner is son of owner of the Tractor, the petitioner, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (ten thousand only) with two sureties of the like amount each to the satisfaction of learned SubDivisional Judicial Magistrate, Dehri (Rohtas), in connection with Forest Case No. 24 of 2013, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
