JUSTICE DINESH KUMAR SINGH ORAL ORDER 18-02-2016 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Section 341, 323, 324, 307, 504 and 506 of the Indian Penal Code.
The prosecution case is that on 02.01.2016 when the informant, along with his family members, was sitting at his door the petitioner came and started throwing fire-wood and on protest being made he assaulted the informant with iron rod causing injury on his hand and thigh. When son of the informant, Umashankar Sah, and daughter-in-law, Lilawati Devi, came to rescue then they were also assaulted by Farsa and when wife of informant, Sarswati Devi, and daughter-in-law, Vimla Devi came they were also assaulted.

No.7260 of 2016 (2) dt.18-02-2016 2/2 It is submitted by the learned counsel for the petitioner that the petitioner has purchased 1 1⁄2 Katha of land from the nephew of informant and for that the informant and his family members were annoyed, on the date of occurrence the petitioner was also assaulted by informant side for which the petitioner lodged a complaint case, though subsequent to lodging of the present FIR, and all the injuries of the injured have been found to be simple in nature.
Considering the genesis of the occurrence and nature of injuries, it is a case of consider the prayer for regular bail of the petitioner in case the petitioner surrenders within six weeks from today in connection with Sidhwalia P.S. case No. 1/2016 pending in the court of learned A.C.J.M., VIII, Gopalganj. This application is disposed of with the aforesaid observation/direction (Dinesh Kumar Singh, J) BKS/- U T
