JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 01-09-2020 Heard Sri Sunil Kumar, learned counsel for the petitioner, learned A.P.P. for the State and Sri Prasant Kumar, learned counsel appearing for informant through video conferencing.
The petitioner seeks bail in connection with Goraul P.S. Case No. 42 of 2019, registered under Section 392 of the Indian Penal Code.
The accusation is that informant Anil Kumar Chaudhary, being the Branch Manager of L.I.C. Goraul Branch, reached at about 9.30 A.M. on 16.02.2019 in his office, then at about 10.00 A.M., four unknown persons aged about 20-25 years, who were speaking in local language
Patna High Court CR. MISC. No.13115 of 2020(4) dt.01-09-2020 2/3 entered in the office and on pointing the pistol at Akhilesh Prakash, Administrative Officer, daily wage employee Subodh Kumar, Security Guard Yugeshwar Pandey and Agent Sarvesh Kumar took cash of Rs. 8, 16,242/- from the safe. At that time, they also took cash of Rs. 1,30,551/- as well as three cheques from agent Sarvesh Kumar, who had come there to deposit the same.
Learned counsel appearing for the petitioner submits that it would appear from the F.I.R. that on the basis of written report of informant Anil Kumar Chaudhary, Goraul P.S. Case No. 42 of 2019 was registered under Section 392 of the Indian Penal Code on 16.02.2019 against four unknown. In course of investigation, one Mantu Kumar was apprehended by the Police in connection with Sarai P.S. Case No. 142 of 2019 in which he confessed his involvement in several cases, including the present case, in company of Ravi Bhusan @ Laddu, Ravi Kumar and Mukesh Singh (Petitioner), later on, the name of petitioner also surfaced in the confessional statement of Rahul Kumar Jha. Thereafter, petitioner was remanded in the present case on 28.06.2019 from Goraul P.S. Case No. 25 of 2019 and since then he is in custody. Further submission is that petitioner is accused in three cases,
Patna High Court CR. MISC. No.13115 of 2020(4) dt.01-09-2020 3/3 including Goraul P.S. Case No. 25 of 2019, out of which he is on bail in Lalgang P.S. Case No. 88 of 2019 and in Sarai P.S. Case No. 142 of 2019 and he has also allowed privilege of bail in Goraul P.S. Case No. 25 of 2019 vide Criminal Miscellaneous No. 9415 of 2020, during the pendency of this application. Further submission is that while informant has detailed physique of the culprit, but the petitioner has not been put on T.I.P.
Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Vaishali at Hajipur in connection with Goraul P.S.
