The petitioner is apprehending his arrest in connection with Dandkhora P.S.Case no.80/2018 instituted on 28.8.2018 , registered for offences punishable under Sections 302, 201, 120(B)/34 of the Indian Penal Code.

Allegation against the petitioner, who happens to be father-in-law of the deceased is of causing death of the deceased along with other accused persons.

Submission of the learned counsel for the petitioner is that the deceased was married with the daughter of the informant and it was love marriage, his dead body was found in the bamboo clumps of the village and the house of the petitioner and the deceased is situated in same village and except suspicion there is absolutely nothing against the petitioner and materials collected during the course of investigation disclose that there was quarrel between the deceased and his wife.

Patna High Court CR. MISC. No.10952 of 2019(3) dt.26-04-2019 2/2 Heard learned A.P.P. , who has opposed the prayer for bail. .

Having heard both sides and in view of the facts and circumstances, as stated above, let the petitioner, above named, in the event of arrest or surrender before the court below within a period of six weeks from the date of receipt of order be released on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned CJM, Katihar in connection with Dandkhora P.S.Case nO.80 of 2018 subject to condition as laid down under Section 438 (2) of the Code of Criminal Procedure, till submission of the charge-sheet however, if any serious incriminating material comes against the petitioner during the investigation, the persecution is at liberty to move for cancellation of his bail bond. Let a copy of the order be communicated to the S.P., Katihar also.

With the aforesaid direction, this application is allowed.
