The petitioner apprehends his arrest in Khajekalan P.S. Case No. 203 of 2012 registered for the offences punishable under Sections 307 and 34 of the Indian Penal Code and under Sections 25(1-b)a, 26, 27, 35 of the Arms Act.

The petitioner is named in the FIR and it is alleged that on the order of Sheru the petitioner Banti made indiscriminate firing causing injury to the informant.

It appears that prayer for anticipatory bail of the petitioner was earlier rejected vide order dated 10.09.2014 passed in Cr. Misc. No. 28102 of 2013.

Considering the facts aforesaid and the fact that the prayer for anticipatory bail of the petitioner had already been

Patna High Court Cr.Misc. No.6257 of 2016 (2) dt.18-07-2016 2/2 rejected earlier, I do not feel inclined to entertain this anticipatory bail petition.

Accordingly, the anticipatory bail petition is rejected. However, the petitioner, if so advised, may surrender before the court below within four weeks from the date of receipt/production of a copy of this order and pray for regular bail, his prayer shall be considered on its own merit without being prejudiced by this order.
