JUSTICE BIRENDRA KUMAR ORAL ORDER 05-02-2021 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State. The petitioner is apprehending his arrest in connection with Bhabhua P.S. Case No.560 of 2019, registered for the offences punishable under Sections 341/323/379/384 / 386/506/34 of the Indian Penal Code.

Allegation against the petitioner is of demand of ransom from the informant and on non-payment commission of assault. The petitioner has got criminal antecedents as disclosed in para-3 of the petition.

Submission is that parties have entered into a compromise.

Considering the nature of allegation and criminal

Patna High Court CR. MISC. No.18403 of 2020(4) dt.05-02-2021 2/2 antecedent of the petitioner, in my view, this is not a fit case for grant of anticipatory bail. Hence, the prayer for anticipatory bail is refused. However, in the event of surrender of the petitioner, the prayer for regular bail shall be considered without being prejudiced by the order of this Court and considering the fact that no ransom was paid and the parties have entered into a compromise.
