JUSTICE DINESH KUMAR SINGH ORAL ORDER 17-03-2015 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 341, 323, 307 and 379/34 of the Indian Penal Code.

It is alleged that petitioner no.1 assaulted the informant with iron rod on the back when petitioner no.2 assaulted with farsa on the head of the informant causing cut injury whereas coaccused Suratiya Devi assaulted the informant with fists and slaps and took away `5,000/-.

It is submitted by learned counsel for the petitioners that the petitioners are the agnates of the informant when the injury has been found to be simple in nature caused by hard and blunt substance. A statement has been made in para 3 of the petition that

Considering the aforesaid facts, let the above named petitioners be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned C.J.M., Sitamarhi in connection with Sahiyara P.S. Case No. 04 of 2015, subject to the conditions as laid down under Section 438(2) Cr.P.C.
