Heard the parties in virtual Court.

The petitioner is languishing in custody for the offence punishable under Sections 272/273/120B of the Indian Penal Code and Sections 30(a) and 32(ii) of the Bihar Prohibition and Excise Act.

Recovery of liquor is alleged from a truck. The driver and the cleaner of the truck from which huge quantity of liquor was recovered have already been allowed bail and they disclosed that the liquor was of the petitioner. Petitioner has got no criminal antecedent. He is in custody since 20.11.2020. Considering no direct material against the petitioner and completion of investigation, let the petitioner, above named,

Patna High Court CR. MISC. No.20939 of 2021(2) dt.26-08-2021 2/2 be released on bail on furnishing bail bond of Rs.20000/- (Twenty thousand) with two sureties of the like amount each to the satisfaction of the learned Court-below where the case is pending in connection with Bochaha P.S. Case No. 315 of 2020, with following conditions:

(a) Both the bailors shall be the resident of territorial jurisdiction of the learned Court-below.

(b) The petitioner shall fully cooperate with the trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.

(c) The petitioner shall not leave the country without permission of the trial Court.
