This is an application seeking anticipatory bail in a case registered for the offences punishable under Sections 394, 302/34 of the Indian Penal Code and Section 27 of the Arms Act. The petitioner is named in the First Information Report. The informant is said to have identified the petitioner. Learned counsel appearing on behalf of the petitioner has attempted to persuade this Court that the petitioner has been implicated because of some old civil dispute between the family of the informant and the petitioner.

This submission cannot be accepted for the purpose of grant of anticipatory bail to the petitioner. In the facts and circumstances of the case, this application for anticipatory bail is

The petitioner is directed to surrender before the Court below within four weeks from today. If he does so and seeks regular bail, it shall be considered on its own merit without being prejudiced by the rejection of the present anticipatory bail application.
