The petitioner seeks anticipatory bail in connection with Katra P.S. Case No. 98 of 2019 dated 28.04.2019 instituted for the offences under Sections 272, 273 and 414 of the Indian Penal Code and Sections 30(a) and 38(1) of the Bihar Prohibition and Excise Act, 2016.

Learned counsel for the petitioners submits that petitioner has got one criminal antecedent in which he has been granted bail by the learned court below.

Learned counsel for the petitioner submits that from bare perusal of the allegation as alleged in the F.I.R. it would manifest that the petitioner was not apprehended from the place of occurrence rather his name has come in the confessional

Learned A.P.P. for the State opposes the prayer for anticipatory bail of the petitioner.

Considering the fact that the petitioner was not apprehended at the place of occurrence and total 6.375 litres of foreign liquor was seized from those who were arrested and the motorcycle, which was seized, also does not belong to the petitioner, the petitioner, in the event of his arrest or surrender before the learned Court below within a period of ten weeks, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned Special Judge, Excise, Muzaffarpur in connection with Katra P.S. Case No. 98 of 2019 dated 28.04.2019 subject to the conditions as laid down under Section 438 (2) of the Cr.P.C. .
