2. The petitioner apprehends his arrest in connection with Bahera P.S. Case No. 265 of 2022 for the offence registered under sections 147, 341, 323, 308 and 385 of the IPC.

As per the prosecution story, the informant alleged that firstly, the accused person stopped the informant from cultivating and demanded extortion and later, came up with 50 to 60 persons, stopped him to cultivate the land and thereafter, the allegation is that at the instance of Ranjay Yadav and Vijay Choudhary, Vijay Yadav, Ram Yadav, Manoj Yadav (petitioner herein) and Sanjay Yadav gave rod blows on the informant's side.

4. Sanjay Yadav attacked Rohit Mishra on the head but it actually hit his hand, Vijay Choudhary gave farsa blow to Chunchun Choudhary while this petitioner gave iron rod blow to Pappu Mishra

Patna High Court CR. MISC. No.12139 of 2026(2) dt.26-02-2026 2/2 both on the head as also the body. The injured persons were rushed to Benipur Sub-Divisional Hospital and then to D.M.C.H., Darbhanga which followed the FIR.

4. Learned Counsel for the petitioner submits that the injuries are not on record, he has been wrongly implicated and has no criminal antecedent.

Learned APP, Mr. Jitendra Kumar Singh, on the other hand opposes the prayer submitting that the FIR is of the year 2022, the petitioner is named in the FIR and allegation is of attacking Pappu Mishra both on the head as also the body, his anticipatory bail was rejected in the year 2024 on the ground that he approached the Court after two years. Still he waited for another two years to file this petition.

6. Considering the aforesaid submissions of the parties as also the facts that have come on record, no case for grant of anticipatory bail is made out.

7. Cr. Misc. No. 12139 of 2026 stands rejected.

8. However, if the petitioner surrenders within four weeks from today, the Court concerned shall take up the matter and dispose it of preferably on the same day.
