2. The petitioners have moved the Court under Section 482 of the Code of Criminal Procedure, 1973 for the following relief:
"That this is an application being filed for invoking the inherent jurisdiction to quash the cognizance order dated 02.01.2008 of Kotwali P.S. Case No. 508/2005, G.R. No. 5714/2005 by which the learned C.J.M. Patna taken cognizance against the aforesaid petitioners Under Section 147, 332, 353, 337 and 427 of I.P.C. which is pending in the Court of Smt. Akanksha Kashyap, J.M. 1st Class, Patna."
3. After some arguments, learned counsel for the
Patna High Court CR. MISC. No.7726 of 2015(2) dt.22-04-2019 2/2 petitioners submitted that the challenge in the present application was to the order taking cognizance but subsequently charges have been framed.
4. Accordingly, he submitted that he may be permitted to withdraw the application with liberty to file an application before the Court below itself at the appropriate stage.
5. In view thereof, the application stands disposed off as withdrawn with liberty aforesaid.
