JUSTICE SANJAY PRIYA ORAL ORDER 15-05-2017 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in Darbhanga Rail P.S. Case No. 16 of 2017 instituted for the offence under Section 414 of the Indian Penal Code.
It has been submitted that petitioner is a lady. She has been arrested by the police merely on suspicion that she is a pick pocket.
As per written report, Mobile phone and other articles were recovered from her possession, but from the written report it appears that nobody has claimed those articles, which have been recovered from the possession of the petitioner. No Test Identification Parade has been done by the police to ascertain as
Patna High Court Cr.Misc. No.16963 of 2017 (3) dt.15-05-2017 2/2 to whether those articles were stolen articles. Petitioner is in custody since 16.2.2017.
Considering the aforesaid facts and circumstances of the case, prayer for bail of the petitioner is allowed. Let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, Rail, Samastipur, in connection with Darbhanga Rail P.S.
