Petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 290, 420, 120B/34 of the Indian Penal Code and 11 of the Gambling Act.
It is alleged that on information that the petitioner used to allow his house for gambling, raid was made and four persons were apprehended along with playing cards and some currency notes.
It is submitted by the learned counsel for the petitioner that co-accused persons were apprehended from the scene, but maliciously the petitioner has been roped in the present case. The petitioner was not present in the house. Statement has been made in para-3 of the petition that
Patna High Court Cr.Misc. No.6160 of 2016 (2) dt.09-02-2016 petitioner has no criminal antecedent.
The aforesaid facts constitute ground for consideration of prayer for regular bail of the petitioner, if the petitioner surrenders before the learned court below within a period of six weeks from today in connection with Sultanganj P.S. Case No. 01 of 2016, pending in the court of learned Chief Judicial Magistrate, Patna City.
With this observation this application is disposed of.
