JUSTICE SANJAY PRIYA ORAL ORDER 7/ 05-07-2019 Heard learned counsel for the petitioner and learned APP for the State as well counsel for the informant. Petitioner seeks bail in Barauni Refinery P.S. Case No.361 of 2018 instituted for the offence under Section(s) 341, 323, 304/34 Indian Penal Code.

Counsel for the petitioner submits that there is no allegation of any specific overt act against the petitioner. In the written report, it is alleged that son of the informant while returning from Madarsa was assaulted by Md. Quasim and Md. Shahjad. Petitioner has been made accused because he is father of Quasim and Shahjad.

Petitioner is in custody since 30.11.2018.

In the facts and circumstances of the case, prayer of

Let the petitioner, above named, be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Begusarai, in connection with Barauni Refinery P.S. Case No.361 of 2018, subject to the condition that both the bailors shall be close relative of the petitioner.
