The petitioners apprehend their arrest in Buxar (M) P.S. Case No. 323 of 2014, registered for the offences punishable under Section 307 and other Sections of the Indian Penal Code. The informant made allegation that the petitioners came to the house of the informant, assaulted and abused the informant and his family members.
Learned counsel for the petitioners submits that petitioner no. 2 is the own brother of Surendra Singh the father of the informant. Petitioner No. 1 is maternal brother of the informant. They are residing under one roof and on account of land dispute some verbal altercation and scuffle took place. The injured got simple injuries as it appears from the injury report

Considering the facts that the petitioners are close agnates of the informant and on account of some scuffling the informant got some injuries that too are simple in nature, the petitioners, in the event of their arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, are directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Buxar in connection with Buxar (M) P.S. Case No. 323 of 2014, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. (Prabhat Kumar Jha, J.) KKSINHA/- U T
