JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 23-03-2015 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner apprehends his arrest in connection with Mehasi P.S. Case No. 79 of 2014 registered for the offences punishable under Sections 341, 323, 325, 324, 307, 504/34 of the Indian Penal Code.
Petitioner and five others are named in the first information report and general allegation of assault has been levelled against all the accused though there is specific allegation of giving rod blow on the right hand of informant against coaccused, Tauseef. The injured has sustained two injuries, out of which one injury on the right wrist joint was found grievous in nature whereas one sharp cutting injury was found on the scalp of
Patna High Court Cr.Misc. No.11382 of 2015 (2) dt.23-03-2015 the injured and the said injury was simple in nature. Considering the aforesaid facts and circumstances as well as submissions of the parties, particularly, keeping in mind that no specific overt-act has been attributed against the petitioner, this anticipatory bail petition is allowed and it is ordered that petitioner, in the event of his arrest/ surrender within four weeks from the date of receipt of this order to the court concerned, shall be released on bail on furnishing bail bonds of Rs 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Sri Rajeev Kumar Bharati, Judicial Magistrate 1st Class, Sadar Motihari, East Champaran in Mehasi P.S. Case No. 79 of 2014 subject to condition as laid down under Section 438(2) of the Cr.P.C.
