JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 17-03-2016 Heard learned Counsel for the petitioners and learned Additional Public Prosecutor for the State. This application, for grant of anticipatory bail, arises out of Ramgarh Police Station Case No. 332 of 2015, disclosing offences under Sections 147, 149, 341, 323, 504 and 307 of the Indian Penal Code.

Learned Counsel for the petitioners submits that all the petitioners belong to the same family. Allegation against them is that all of them assaulted the informant

Patna High Court Cr.Misc. No.7570 of 2016 (2) dt.17-03-2016 2/3 with lathi and khanti. It is also alleged that when the wife of the informant came in his rescue, they assaulted her also. He submits that no grievous injury, on vital part of the body of the informant or his wife, has been found. He further submits that neither any motive has been assigned in the First Information Report nor there is specific allegation of assault against these petitioners. Considering the facts and circumstances, nature of accusation and statement made in paragraph 3 of this application that the petitioners have no criminal antecedent, this application is allowed.

Let the petitioners, namely, Bal Govind Bind, Mosafir Bind, Suresh Bind, Ramesh Bind, Ram Pravesh Bind, Dinesh Bind, Ghura Bind, Sadhu Bind and Deepak Bind, in the event of their arrest or surrender before the Court below within six weeks from today, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Kaimur at Bhabhua, in connection with Ramgarh Police Station Case No. 332 of 2015, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure.
