NILU AGRAWAL ORAL ORDER 12-04-2017 Heard learned counsel for the petitioners and the learned A.P.P. for the State.

Petitioners are languishing in judicial custody since 25.11.2016 in connection with Jaipur P.S. Case No. 01/2016 registered for the offences punishable under Sections 406, 341, 323, 337, 447, 307, 504 of the Indian Penal Code and Section 3⁄4 of the Explosive Substances Act.

The prosecution case, as lodged by the informant, is that while he was returning home the petitioners along with one other hurled bomb at him, resultantly he sustained injuries. It has been submitted by the learned counsel for the petitioners that they are innocent, petitioner no. 1 bears no

No.15580 of 2017 (2) dt.12-04-2017 2/2 criminal history and petitioner no. 2 is also accused in another case of different nature and they have been falsely implicated due to various civil disputes between the parties. It is submitted that both the parties are agnates and the informant is a veteran criminal, against whom number of criminal cases are pending. It is further submitted that as per the injury report and the supplementary injury report, the injuries have been found to be simple in nature.

However, learned A.P.P. for the State opposes the prayer for bail.

Considering the facts and circumstances and the materials on record, let the petitioners, above named, be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rs. ten thousand only) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Banka in connection with Jaipur P.S.
