The petitioners are apprehending their arrest in a case registered for the offence punishable under Sections 414 of the Indian Penal Code and 30 (A) of the Bihar Prohibition and Excise (Amendment) Act, 2018.

Learned counsel for the petitioners submits that there is recovery of 24.120 liters of foreign liquor from Maruti Sujuki Wagnor car and the petitioners have been made accused on the confessional statement of co-accused. There is no recovery from the conscious possession of the petitioners. The petitioners have no criminal antecedent.

In the aforesaid facts and circumstances of the case, I am inclined to grant anticipatory bail to the above named petitioners, in the event of their arrest or surrender before the Court below within a period of six weeks from the date of receipt of the order, be released on anticipatory bail on furnishing bail bonds of Rs. 20,000/- (rupees twenty thousand) each with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge-3rd cum Special Judge, Excise, Kaimur at Bhabhua, in connection with Kudra P.S. Case No. 354 of 2019, subject to the conditions as laid down under Section 438 (2) of the Code of Criminal Procedure. (Anjani Kumar Sharan, J) amitkumar/- U T
