ANJANA MISHRA ORAL ORDER 16-02-2016 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

The petitioner apprehends his arrest in connection with a case registered for the offences punishable under Sections 409 and 353 of the Indian Penal Code.

Learned counsel for the petitioner submits that the only allegation against the petitioner is that he did not hand over charge of the Malkhana on his transfer from Police Station Sheikhpura. He, however, submits that the petitioner is willing and ready to hand over charge though he has requested the authorities to take over the charge. On several occasions, they have not co-operated with him and lodged the present case.

Considering the undertaking by the petitioner that he is

Patna High Court Cr.Misc. No.9466 of 2015 (5) dt.16-02-2016 P2/2 willing to hand over the charge of the Malkhana within a period of two weeks from the date of communication of a copy of this order, let the petitioner, in the event of his arrest / surrender within a period of four weeks from the date of receipt/production of a copy of this order, be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the each amount to the satisfaction of the learned Chief Judicial Magistrate, Shiekhpura in connection with Sheikhpura P.S. Case No. 19 of 2014 subject to the conditions as laid down under Section 438(2) of the Cr. P.C.

It is made clear that the petitioner shall surrender in the Court below along with a copy of the charge report for furnishing his bail bonds and other documents.

Let a copy of the order be communicated to the Superintendent of Police, Sheikhpura, so that he can make necessary arrangements to facilitate the petitioner so that the petitioner may hand over the charge of the concerned Malkhana within the aforesaid period.
