In the instant petition, petitioner has prayed for the following reliefs:- "(i) For issuance of any appropriate writ or writs, Rule or direction especially in the nature of Mandamus, commanding and directing the respondent authorities (Authorised Officer)- Cum- Chief Manager (Uttar Bihar Gramin Bank, Araria) to consider the request of petitioner to facilitated and opportunity to pay the debt amount Rs. 09,04,612 (Rs. Nine Lakhs Four thousand and Six Hundred Twelve) in a five equal installments to substantiate and acquitable justice.

(ii) Further the respondent authorities not to take the physical possession of the Mortgage property bearing Mauza-Gorthra, Thana No. 16, Khata No.-121, Khesra No.-

Patna High Court CWJC No.2493 of 2023(3) dt.16-05-2023 2/2 2575, Area- 3 decimals, Title Deed No.- 2043 dated 19.03.2013 till the disposal of the present writ application, and further stay the operation of general Notice dated 18.01.2023 issued under the signature of an authorized officer/Chief Manager of Uttar Bihar Gramin Bank, Araria.

And/or Pass such other order/orders as your Lordships may deem fit and proper in the facts and circumstances of the case."

3. The present petition is dismissed as not maintainable since the petitioner has remedy before the appropriate forum.
