JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 08-05-2019 An order taking cognizance passed by the learned Chief Judicial Magistrate, Siwan dated 31.10.2014, passed in Hussainganj Police Station Case No. 181 of 2014 for the offences punishable under Section 395 of the Indian Penal Code is being assailed in the present application filed under Section 482 of the Code of Criminal Procedure, 1973.

This matter has been taken up more than four years after its filing. There is no clue as regards the present status of the case as there is no representation on behalf of the petitioner. Upon perusal of the impugned order dated 3.10.2014, it is noticeable that the learned Chief Judicial Magistrate, Siwan has taken note of the fact that the materials available on record constituted offence for the purpose of taking cognizance.
