The petitioner is accused in connection with Araria P.S. Case No. 656/2016, registered under Sections 379 and 411 of the Indian Penal Code.
Submission is that the petitioner is not named in the FIR. During course of investigation name of the petitioner surfaced in the present case. Soyeb was apprehended by the police and on his disclosure the stolen motorcycle was recovered by the police, which would appear from paragraphs 13 and 16 of the case diary and Soyeb also disclosed the name of the petitioner as a culprit having hand in the occurrence of the present case. Patna High Court Cr.Misc. No.12251 of 2017 (4) dt.03-05-2017 recorded the confessional statement of the petitioner vide paragraph 35 of the case dairy and thereafter the petitioner has been remanded in this case. The petitioner is in custody since 28.09.2016.
Having regard to the facts and the circumstances of the case, the petitioner Belal @ Belal Ansari, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Araria in connection with Araria P.S. Case No. 656/2016, Out of two sureties, one surety must be the close relative of the petitioner.
