Petitioners are apprehending arrest in connection with Mohania P.S. Case No. 505 of 2019 for the offence under sections 147, 148, 149, 153(A), 353, 337, 504 of the Indian Penal Code.

Learned counsel for the petitioners submits that in connection with a protest against the occurrence of rape, the petitioners and approximately 150 persons joined the protest. The protest led scuffle when people of two communities started pelting stones and the police intervened in the matter and used force to maintain public order.

No.9913 of 2020(2) dt.03-03-2020 2/2 Considering the fact that petitioners were involved in protesting against the law and order problem which led scuffle between two communities, the Court is inclined to grant anticipatory bail to the petitioners, let the petitioners, named above, in the event of arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, be enlarged on bail on furnishing bail bond of Rs. 50,000/- (Fifty thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Kaimur at Bhabhua, in connection with Mohania P.S. Case No. 505 of 2019 subject to the condition that one of the bailors should be elected representative of the local body as also the condition as laid down under section 438(2) of the Cr.P.C.
