JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 19-02-2015 Heard learned counsel for the petitioners as well as learned Additional Public Prosecutor for the State. Petitioners apprehend their arrest in connection with Atari P.S. Case No. 45 of 2012 registered for the offences punishable under Sections 341, 323, 504, 370, 386 of the Indian Penal Code.
First information report named accused, Ram Pravesh Yadav is co-sharer of the informant and admittedly, he resides in the same house in which the informant resides. Furthermore, it would appear from perusal of the first information report that an altercation took place between Ram Pravesh Yadav and informant on 08.03.2012 and thereafter, on 09.03.2012 the petitioners, who happen to be in-laws of the aforesaid Ram Pravesh Yadav,
Patna High Court Cr.Misc. No.6617 of 2015 (2) dt.19-02-2015 threatened the informant and when on the complaint of the informant police conducted enquiry, the petitioners and other first information report named accused assaulted the informant and also snatched his belongings.
Petitioners do not have any criminal antecedent. Considering the aforesaid facts and circumstances as well as submissions of the parties, this anticipatory bail petition is allowed and it is ordered that petitioners, in the event of their arrest/ surrender within four weeks from the date of receipt of this order to the court concerned, shall be released on bail on furnishing bail bonds of Rs 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Gaya in Atari P.S. Case No. 45 of 2012 subject to condition as laid down under Section 438(2) of the Cr.P.C.
