Patna High Court CWJC No.3281 of 2015 dt.30-06-2015 2 / 2 Time was granted earlier to the State to verify as to under what circumstances similarly situated persons working as Tuberculosis Assistants have been granted benefit of ACP for which petitioners have annexed certain notifications. They have also pointed out the names in the rejoinder application.

Since the State has failed to shed any light on such assertion, the responsibility is now thrust upon the Director-in-Chief, Health Services, Government of Bihar that on an application being filed by the petitioners with supporting evidence for grant of such benefit, matter will be verified whether such claim is valid or not and if it is found to be in order, then the claim of the petitioners can also be considered and appropriate decision will be taken within a period of three months from the date of filing of such application. Writ application is disposed of with above direction. (Ajay Kumar Tripathi, J) R.K.Pathak/- U
