The petitioner seeks bail in Salkhua P.S. Case No. 204 of 2016 under Section 307 and other allied Sections of the Indian Penal Code and under Section 25(1-b)a, 26 of the Arms Act. Allegation against the petitioner is that he fired upon the informant by a small firearm, which did not hit the informant. Learned counsel for the petitioner submits that the informant has got no firearm injury and he is in jail since 16.1.2017.
Considering the fact that no injury was caused to anyone and the petitioner is in jail since one and half months, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two
Patna High Court Cr.Misc. No.9955 of 2017 (2) dt.06-03-2017 2/2 sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate-II, Saharsa in salkhua P.S. Case No. 204 of 2016.
