The petitioner seeks bail in a case registered for the offence under Section 21 of the N.D.P.S. Act and Section 141 of the Railway Act.

As per the prosecution case, 56 tablets of Alprax, one blade piece, cash of Rs. 600/- and one Intel company mobile phone have been recovered from the possession of petitioner. It is alleged that petitioner and co-accused Dilip Mahto used to mix the aforesaid tablets in tea / cold drink of passengers to make them unconscious / senseless for committing theft of their articles.

It is submitted on behalf of petitioner that petitioner has been made accused in this case only on suspicion. Petitioner has got no concern with the alleged Nasha Khurani Giroh.

Patna High Court CR. MISC. No.11727 of 2022(2) dt.09-05-2022 2/2 Petitioner is in custody since 08.01.2022. Investigation is complete.

Learned A.P.P. for the State has opposed the bail petition.

Considering the period of custody, the bail petition of petitioner is allowed. Let the above named petitioner be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned District and Sessions Judge, Begusarai in connection with N.D.P.S. Case No. 03 of 2022, arising out of Bachhwara Rail P.S. Case No. 03 of 2020.
