JUSTICE NAWNEET KUMAR PANDEY ORAL ORDER 22-03-2023 Heard the learned counsel for the petitioner as well as the learned Additional Public Prosecutor for the State. The petitioner is seeking regular bail in connection with Gardanibagh P.S. Case No. 54 of 2016, registered for the offences punishable under Sections 419, 420, 467, 468, 471/34 of the Indian Penal Code.

There is allegation that one Vikash Kumar was attempting to join in the branch of State Bank of India, Gardanibagh, on the basis of forged appointment letter. The learned counsel for the petitioner has submitted that the named of the petitioner has figured in confessional statement of Vikash Kumar, who has been granted bail. The

On the other hand, the learned counsel for the S.B.I. has opposed the prayer for bail and submitted that it was the petitioner, who provided forged appointment letter to Vikash Kumar, after taking money from him and Vikash Kumar as well as the bank itself were defrauded by the petitioner. Considering the above-mentioned facts and circumstances, and also considering the fact that the name of the petitioner has figured in confessional statement of co-accused, who has been granted bail, let the petitioner above-named be released on bail on furnishing bail bonds of Rs.10,000/- with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate-Ist Class Patna in connection with Gardanibagh P.S. Case No. 54 of 2016, subject to the following conditions:- (i) The learned court below, before accepting the bail bond shall verify the criminal antecedent of the petitioner.

(ii) If it is found that the petitioner is involved in any other case of similar nature, the learned court below shall be at liberty to cancel his bail bond. (iii) The petitioner shall remain physically present on
