This application, for grant of anticipatory bail, arises out of Kudhani Police Station Case No. 525 of 2019, disclosing offences under Sections 379/353/34 of the Indian Penal Code. The prosecution case, as per the First Information Report, is that the informant, who is the Woman Supervisor of Ward Nos. 7/11 of Aktiyarpur Kamtaul Panchayat, had gone to conduct selection process of Sevikas and Sahaiyikas and for

No.10545 of 2020(2) dt.23-06-2020 2/3 which an Aam Sabha was held, but the petitioners created hindrance in the selection process and snatched away the file containing the merit list, application forms etc. Learned Counsel for the petitioners submits that the petitioners have falsely been implicated in this case inasmuch as the petitioner nos. 3 and 4 were themselves candidates for selection to the post of Sevika and Sahayika and they were placed at Serial No. 1 in the merit list prepared for selection of Sevika and Sahayika respectively. He further submits that in order to oust the petitioner nos. 3 and 4 from the race, the present false and concocted case has been lodged against them with oblique motive. He further submits that the petitioner no. 1 is the husband of petitioner no. 3 and the petitioner no. 2 is the father of petitioner no. 4.
Having regard to the submissions made on behalf of the parties and taking into consideration the fact that the petitioner nos. 3 and 4 were themselves candidates for the post of Sevika and Sahayika and petitioner nos. 1 and 2 are husband and father of petitioner nos. 3 and 4 respectively, I am inclined to grant the petitioners privilege of anticipatory bail. This application is, accordingly, allowed.
Let the petitioners, above named, in the event of their
Patna High Court CR. MISC. No.10545 of 2020(2) dt.23-06-2020 3/3 arrest or surrender before the Court below within six weeks from today, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-III, West, Muzaffarpur, in connection with Kudhani Police Station Case No. 525 of 2019, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure.
