For the Opposite Party :
Mr. S.N. Shukla, APP ====================================================== CORAM: HONOURABLE MR. JUSTICE ASHUTOSH KUMAR ORAL ORDER 07-05-2019 Nobody appears on behalf of the petitioner.
Heard the learned counsel for the State.
The petitioner, who was made accused in Hathwa P.S. Case No. 02 of 2014 instituted for the offences under Sections 147, 148, 341, 323, 337, 307, 504 and 427 of the Indian Penal Code approached the court below for grant of anticipatory bail.
The court below directed the petitioner to surrender within fifteen days of the order which was passed on 05.02.2014 and seek regular bail. The petitioner did not surrender for about a year. However
Patna High Court CR. MISC. No.11308 of 2015(2) dt.07-05-2019 2/2 after some of the persons were granted bail, a petition was filed on behalf of the petitioner to extend the period of surrendering before the court below.
Such a request was turned down.
There is no reason for this Court to interfere with the order dated 11.02.2015, whereby the request for extension of time for surrendering before the court below was rejected. The petitioner, for all this Court knows, may have surrendered by this time.
Since there is no representation on behalf of the petitioner, the stage of the case is not known. Considering the aforestated aspects, the petition is dismissed.
