The petitioner seeks bail in Mokama P.S. Case No. 187 of 2012, registered for the offence punishable under Section 394 of the Indian Penal Code.
As per the prosecution case, two unknown miscreants looted purse, mobile and vehicle of informant. It is submitted on behalf of the petitioner that petitioner is not named in the FIR. Name of this petitioner surfaced in this case during course of investigation. No incriminating article has been recovered from possession of this petitioner. Petitioner has not been put on test identification parade till date. Only material that has come against this petitioner is that he had talk with co-accused Rohit Kumar on his mobile. Petitioner has been remanded in this case on
Patna High Court CR. MISC. No.11992 of 2022(2) dt.09-05-2022 2/2 02.07.2021. Investigation is complete.
Considering the facts and circumstances of the case, the petitioner above-named, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate 2nd, Barh, Patna in connection with Mokama P.S.
