In this case, the petitioner is challenging the order dated 27.4.2016 passed by the District Magistrate, Jehanabad in Appeal Case No. 17/D.M./2015 affirming the order dated 12.11.2014 passed by the Sub-Divisional Officer, Sadar, Jehanabad cancelling the P.D.S. license of the petitioner without dealing with the objection raised by him in the appeal.
Learned counsel for the petitioner has tried to make out a third case which was not there in the Memo of Appeal cannot be allowed.
After some arguments, learned counsel for the petitioner
Patna High Court CWJC No.14318 of 2016 dt.04-09-2017 submits that he may be allowed to withdraw this writ application with a liberty to approach to the Revisional Authority. This application is, accordingly, dismissed as withdrawn with a liberty to the petitioner to file revision application. If the petitioner files a revision application within a period of three weeks from today, the Revisional Authority will consider the same and will pass orders on merit within a period of four months from the date of filing of the revision by the petitioner. While considering the issue of limitation, the Authority will take into consideration the pendency of this writ application before this Court.
