====================================================== CORAM: HONOURABLE MR. JUSTICE MADHURESH PRASAD ORAL ORDER 04-04-2019 Heard learned counsel for the petitioner as well as learned counsel for the State.

Petitioner's claim for grant of B.A. trained scale on the ground that juniors to the petitioner have been granted the same, is pending consideration before the District Education Officer, Samastipur (respondent no.5). Petitioner had made his representation dated 24.12.2012. It is submitted that till date he is being deprived of the scale due to non-consideration of his claim by respondent no.5.

In view of a limited grievance, the writ petition is disposed of with a direction to respondent no.5 to pass a reasoned and speaking order on petitioner's claim taking into

Patna High Court CWJC No.3102 of 2016(2) dt.04-04-2019 2/2 consideration the assertion of the petitioner that his juniors including Anita Kumari, Arun Kumar, Manoranjan Kumar and Grish Kumar, whose promotional order dated 24.12.2012 is enclosed as Annexure 8 of the writ petition, have been granted promotion. Let the final decision be taken within eight weeks from the date of receipt/production of a copy of this order. It is needless to say that if the claim of the petitioner is found to be correct then the consequential benefits be granted to the petitioner within four weeks thereafter. Writ petition stands disposed of.
