JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 17.05.2017 Heard learned counsel for the petitioner as well as learned Addl. Public Prosecutor for the State.
Again, I am not inclined to release the petitioner on bail taking note of his criminal antecedent and facts and circumstances of the case and accordingly, his prayer for bail in connection with Session trial no. 274/2016 arising out of Ahiyapur P.S. Case no. 958/2015 pending in the court of Addl. Sessions Judge XIII, Muzaffarpur stands rejected.
However, learned trial court is directed to expedite the trial of the petitioner even by separating his case record from the case of absconder co-accused persons. It is made clear that if trial of the petitioner is not concluded within six months from the date of receipt/production of a copy of this order, petitioner may renew his prayer for bail before the trial court itself. shahid (Hemant Kumar Srivastava,J) U T
