Mr. Sanjay Kumar Singh, APP ====================================================== CORAM: HONOURABLE MR. JUSTICE ASHUTOSH KUMAR ORAL ORDER 11-09-2020 Heard Mr. Manish Kumar No. -2, learned counsel for the petitioner and Mr. Sanjay Kumar Singh, learned APP for the State.

This is an application for grant of bail in connection with Sessions Trial No. 133 of 2018 / 539 of 2018, arising out of Imamganj P. S. Case No. 60 of 2018 dated 23.05.2018, instituted for the offence under Section 302 of the Indian Penal Code.

The petitioner is the husband of the deceased. The F.I.R. discloses that the niece of the informant disclosed that her mother was being assaulted by the petitioner. Later, the informant was told that the deceased has died.

Patna High Court CR. MISC. No.9734 of 2020(5) dt.11-09-2020 2/3 The learned counsel for the petitioner has submitted that from the seizure list which is part of the casediary, it would appear that some burnt photographs were seized at the time of the search of the house of the petitioner.

According to the learned counsel for the petitioner, the deceased had fought with her husband and in a huff, was destroying the family photographs. She also tried to immolate herself. An effort to extinguish the fire by the petitioner led to certain injuries on his person also. However, regard being had to the nature of accusation and the fact that the children of the deceased also told the informant that the deceased was assaulted prior to her death, I am not inclined to grant bail to the petitioner for the present.

The prayer for bail is rejected.

However, looking at the fact that the petitioner is in custody since 23.05.2018 and up till now only one witness has been examined, this Court directs that the trial be concluded as expeditiously as possible, preferably within a

Patna High Court CR. MISC. No.9734 of 2020(5) dt.11-09-2020 3/3 period of nine months from the date of production/receipt of a copy of this order.

If there is no substantial progress in the trial for no fault of the petitioner, he would have the liberty to approach this Court again for grant of bail.
