Heard learned counsel for the petitioner as well as learned APP for the State.
The petitioner apprehends his arrest in connection with Dehri(Town) P.S. Case No. 918 of 2020, registered for the offences punishable under Sections 363 of the Indian Penal Code.
Informant Tabrej Alam is brother of the victim. As per allegation, the present petitioner kidnapped his sister with intent to perform marriage with her.
The learned counsel for the petitioner has submitted that the alleged victim girl and the present petitioner was in love
Patna High Court CR. MISC. No.11680 of 2022(2) dt.17-09-2022 2/2 and affection and the victim went with the petitioner with her own sweet will and he has falsely been implicated in this case. On the other hand, the learned Addl.P.P. Sri Shyam Kumar Singh has opposed the prayer for bail.
The statement of the victim has been recorded under Section 164 of the Cr.P.C. She has stated that petitioner has forcibly kidnapped her at Thana Mor Dehri and thereafter, petitioner demanded Rs 500/- from her. He locked her in a car and shut her mouth. In my view, it is not a fit case for anticipatory bail. Accordingly, it is rejected. The petitioner is directed to surrender before the court below and make a prayer for regular bail.
Office shall ensure that all defects are removed by the petitioner within the stipulated time provided in para-1 hereinabove, failing which the matter shall be brought to the notice of this Court.
