The petitioner seeks bail in Sonepur P.S. Case No. 164/2016, registered for the offences punishable under Section 376 and other sections of the Indian Penal Code. The informant father of the victim made allegation that the petitioner made an attempt to outrage the modesty of his daughter on 13.04.2016 and assaulted her with blade causing injury on her hand.

Learned counsel for the petitioner submits that the occurrence took place on 13.04.2016, but the F.I.R. was lodged on 28.04.2016. The victim herself made her statement under Section 164 Cr.P.C. after more than three weeks of the occurrence and she disclosed that the petitioner made attempt to outrage her modesty.

Patna High Court Cr.Misc. No.11963 of 2017 (3) dt.08-04-2017 The injury found on the person of the victim is simple in nature. Considering the facts aforesaid and the fact that the petitioner is in jail for about three months, the petitioner abovenamed, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate Ist, Saran at Chapra in connection with Sonepur P.S. Case No. 164/2016.
