Petitioner apprehends arrest in registered for the offences punishable under Section 323, 504/34 and other allied sections of the Indian Penal Code and section 27 of the Arms Act.

As per the prosecution case, the petitioner and other accused persons demanded Rs. 5 lacs as protection money by the informant and on refusal they robbed paddy and wheat crops on the point of illegal weapons.

Learned counsel for the petitioner submits that the petitioner has falsely been implicated in this case. There is general and omnibus allegation against all the accused persons

Patna High Court CR. MISC. No.12225 of 2022(2) dt.16-08-2022 2/2 and no specific overt act has been alleged against the petitioner. There is no allegation of firing against the petitioner. There is land dispute between the parties.

Learned counsel for the State and the informant oppose the prayer for bail submitting that besides the allegations made against the petitioner in the FIR, he is accused in more than 10 similar cases.

Considering the criminal antecedents of the petitioner, his prayer for bail is refused with direction to surrender and seek regular bail which would be considered and disposed of on its own merit without prejudice.
