This is a petition for grant of regular bail for offences under Sections 25(1-B)A, 26 and 35 of the Arms Act.
Three persons were arrested along with fire arms. They disclosed that few days ago, the petitioner and coaccused, Santosh, were planning to commit murder. Submission of the petitioner is that preparation to commit murder is no offence and other offences are not attracted against the petitioner. More over, only material is confessional statement of co-accused.
Considering the aforesaid fact, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/- (rupees ten thousand) with two sureties of the like amount each in connection with Pakridayal P.S. Case No. 120 of 2016 to the
Patna High Court Cr.Misc. No.15890 of 2017 (2) dt.04-04-2017 2/2 satisfaction of the Chief Judicial Magistrate, East Champaran at Motihari, or successor Court with the condition that the petitioner shall fully cooperate with the investigation/trial of the case, failing which the Court below shall be at liberty to cancel the bail bond of the petitioner.
