The petitioner seeks bail in anticipation of his arrest in connection with Kumarkhand P. S. Case No. 71 of 2020, dated 26.03.2020, instituted for the offences under Sections 147, 148, 149, 323, 307, 379, 504 and 506 of the Indian Penal Code.

Altogether 11 persons have been made accused in this case and so far as the petitioner is concerned, he is said to have assaulted the husband of the informant, who has received grievous injuries.

The learned advocate for the petitioner has

Patna High Court CR. MISC. No.21058 of 2021(3) dt.07-02-2022 2/2 submitted that there is a counter version of the occurrence and the petitioner is the next door neighbour of the informant. He is also an agnate of the informant and the injured.

Be that as it may, regard being had to the fact that the victim has suffered grievous injuries at the hands of the petitioner, I am not inclined to grant anticipatory bail, notwithstanding the other mitigating features of this case. The prayer for anticipatory bail is rejected. However, if the petitioner surrenders before the court below and seeks bail, all the grounds noted above shall be taken into account and an order shall be passed, without being prejudiced by the fact that the present petition on his behalf has not been entertained by this Court.
