ANJANA MISHRA ORAL ORDER (Per: HONOURABLE THE ACTING CHIEF JUSTICE ) 30-03-2016 Heard Mr. Santosh Kumar Singh, learned Counsel for the petitioner, and Mr. Ashok Kumar Chaudhary, learned Additional Advocate General No. 13, appearing for the State respondents. With the help of this writ petition, made under Article 226 of the Constitution of India, in the form of Public Interest Litigation, the petitioner has expressed his grievance as against alleged proposal to shift Narayani Kanya Girls High School,

Patna High Court CWJC No.3853 of 2015 (4) dt.30-03-2016 Patna City, from its present place to another locality. By filing their counter affidavit, the State respondents have submitted to the effect that till now, no decision has been taken by them to shift the school, in question, from the place, where it is presently located.

In view of the above, we close this writ petition with liberty to the petitioner to approach this Court with appropriate application, in future, if the situation so warrants and/or take recourse to such provisions of law, as may be permissible. We also direct the respondents to take the grievances of the petitioner into consideration before any decision is taken as regards shifting of the school, in question, to any place other than the one, where it is presently located.

With the above observations and directions, this writ application shall stand disposed of.
