JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 11-02-2015 Heard learned counsel for the petitioners and learned Additional Public Prosecutor for the State. Petitioners apprehend their arrest in connection with Kahalgaon (Rasulpur) P.S. Case No. 554 of 2014 registered for the offence under Sections-457, 380 of the Indian Penal Code. Although petitioners are named in the first information report but admittedly, the petitioners were neither caught at the spot nor anything has been recovered from their conscious possession. Moreover, petitioners do not have any criminal antecedent and they are co-villagers of the informant, who lodged the case on 27-11-2014 at about 3.00 p.m. whereas; the occurrence had taken place in the night of 26-11-2014. Taking into consideration the aforesaid facts and circumstances as well as submission of the parties, let the

Case No. 554 of 2014 to the satisfaction of Chief Judicial Magistrate, Bhagalpur subject to conditions as laid down u/S 438(2) of the Cr. P.C.
