JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 20-04-2017 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner is accused in connection with Bhore P.S. Case No. 219 of 2016 registered under Section 366(A)/34 of the Indian Penal Code.

The accusation is of kidnapping the daughter of informant by this petitioner with the help of his father and mother with intention to perform the marriage.

Learned counsel for the petitioner submits that while petitioner is named in the F.I.R. along with his father and mother but the victim has not disclosed the name of the petitioner and his family members in her statement recorded, under Section 164

Patna High Court Cr.Misc. No.15066 of 2017 (2) dt.20-04-2017 Cr.P.C., about carrying her at the time of going to attend the call of nature. Further submission is that petitioner is in custody since 24.11.2016.

Having regard to the facts and the circumstances of the case, the petitioner above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate-XII, Gopalganj, in connection with Bhore P.S. Case No. 219 of 2016. Out of two sureties, one surety must be the close relative of the petitioner. (Rajendra Kumar Mishra, J) Bhardwaj/- U T
