The petitioner seeks regular bail in connection with Excise Case No.55 of 2020 arising out of Kudra P.S.Case No.15 of 2020, registered for offences punishable under Section 414 of the Indian Penal Code and Section 30(a) of the Bihar prohibition and Excise (Amendment) Act, 2018. Police on information that several liquor traders are assembled for taking liquor from Bastalawa village, raided the place and one person trying to free from the car was arrested and from the car there is recovery of 216 ltrs. of liquor and the car belongs to the petitioner. There was also recovery from the field of the co-accused persons.

Submission of the learned counsel for the petitioner is that only on suspicion he has been arrested, having no criminal

Having heard both sides and in view of submissions as made above and it is also the first offence of the petitioner, let the petitioner, above named, be enlarged on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned Special Judge (Excise), Kaimur at Bhabua/ADJ-IIIrd cum Spl. Judge (Excise) Act, Kaimur at Bhabua in connection with Excise Case No.55 of 2020 arising out of Kudra P.S.Case No.15 of 2020 with condition that he will co-operate in the investigation, if it is pending.

Accordingly, this application is allowed.
