Petitioner seeks bail in a case registered for the offences punishable under Sections 17 and 18 of the Narcotic Drugs and Psychotropic Substances Act, 1985.

About three kilograms of liquid said to be extract of opium was recovered from the possession of the petitioner. Submission of the petitioner is that the petitioner has got no criminal antecedent and he is in custody since 25.05.2016. His further submission is that as yet it has not been established, in absence of the forensic examination of the recovered article whether it is extract of opium or otherwise. Considering the aforesaid facts, let the petitioner, above named, be released on bail on furnishing bail bond of

Patna High Court Cr.Misc. No.14354 of 2017 (4) dt.15-05-2017 2/2 Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge, Gaya (A.D.J. 1st, Gaya)/successor Court in connection with NDPS Case No. 11 of 2016 arising out of Barachatti Police Station Case No. 172 of 2016, subject to the condition that the petitioner shall fully cooperate with the investigation and trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner as well as condition that both the bailors shall be resident of the territorial jurisdiction of the learned court below.
