The petitioner is an accused in connection with Kharagpur P.S. Case No. 174 of 2016, registered under Section 302/34 of Indian Penal Code, pending in the Court of ACJM-IV, Munger. The accusation is that petitioner along with D.C. Bind, Dhiraj Kumar and unknown caused death of Sunny Kumar, son of the informant, by caused assault and penetrating tube light in his anus. Learned counsel appearing on behalf of the petitioner submits that Rana Paswan and Birendra Pawan, brother of the informant have stated that the petitioner along with others were seen causing assault to the deceased, but both raised strong suspicion about penetrating the tube light in the anus of deceased against D.C. Bind. Learned counsel for the State vehemently opposed the
Patna High Court Cr.Misc. No.8173 of 2017 (3) dt.26-04-2017 2/2 prayer of the petitioner and submits that post mortem report corroborates the injury, which is alleged to be caused by the petitioner and D.C. Bind.
Having considered the facts and circumstances of the case and nature of allegation, I am not inclined to enlarge the petitioner on bail. Accordingly, prayer of the petitioner, above named, is rejected.
