The petitioner seeks bail in a case registered under Sections 406, 409, 420, 465, 468, 470, 120(B)/34 of the Indian Penal Code.

Allegedly, the petitioner conspired and with the help of rumour of loot by Nuxlites, misappropriated Rs. 27,89,288/- meant for construction of Panchayat Bhawan under Yojana No. 01 of 2010-11.

It has been submitted on behalf of the petitioner that the petitioner has got no criminal antecedent. There is no allegation of tampering of witnesses alleged against the petitioner. The petitioner is in custody since 12-12-2019. Charge sheet has already been submitted. The petitioner has been made accused in the present case due to mistake of fact. The petitioner

Patna High Court CR. MISC. No.11711 of 2020(2) dt.28-02-2020 2/2 happens to be the contractor who had to construct Panchayat Bhawan. The informant is the SHO of local police station who has no concern with the Panchayat Bhawan. There was no complaint about misappropriation of fund by any of the elected members of the Panchayat. The project site is in a nuxlite area and for carrying out the construction work, he had sought for a police protection but after repeated requests, the police protection was not given to the petitioner. Hence he stopped the work.

On behalf of the State, it is submitted that the petitioner is named in the Complaint Case/F.I.R.

Considering the aforesaid facts and circumstances, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-IVth, Munger in connection with Khadagpur P.S. Case No. 126 of 2012.
